These Terms of Service ("Terms") explain the rules that apply when you access or use our website, place an order, or otherwise use any services we provide (together, the "Services").

By using our Services, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

These Terms work together with our Privacy Policy, Refund Policy, Shipping and Returns page, Warranty page, Authentication page, and Condition Grading page, all of which form part of these Terms by reference. Where a specific document conflicts with these Terms, these Terms govern unless the specific document expressly states otherwise.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the website. The "Last Updated" date above shows when the current version took effect.

2. Definitions

"Item" or "Bag" – any pre-owned luxury good listed for sale on TheLuxeArchive.

"Order" – a request to purchase an Item placed through our website.

"Authentication" – the independent verification process each Item undergoes, performed by LegitGrails, before listing.

"Certificate" – the authentication certificate issued by LegitGrails in connection with a specific Item.

"Condition Grade" – the grading assigned to an Item under our Condition Grading standards (Pristine, Excellent, Good, Fair, or As Is).

"User," "you," or "your" – any individual accessing or using the Services, whether as a visitor or customer.

"Brand" or "Third-Party Brand" – any trademark, logo, or design belonging to companies whose products are listed for resale on TheLuxeArchive. TheLuxeArchive is independent of all such brands.

Luxearchive Company Limited is a company registered in Hong Kong. We operate a curated resale marketplace for pre-owned luxury goods. We are not affiliated with, sponsored by, or endorsed by any of the brands whose products we sell.

4. Nature of the Marketplace

TheLuxeArchive purchases and takes ownership of every Item before it is listed for sale. TheLuxeArchive is the seller of record for all Items sold through the website, and these Terms, together with applicable consumer protection law, apply accordingly.

Every Item listed on TheLuxeArchive has been authenticated by LegitGrails and assigned a Condition Grade before listing, in accordance with our Authentication and Condition Grading pages.

5. Eligibility and Account Registration

You must be at least 18 years old to place an Order. By using the Services, you confirm that you meet this requirement.

Creating an account requires you to provide accurate and complete information and to keep it updated. You are responsible for protecting your login details and for all activity under your account. Contact us at info@theluxearchive.co immediately if you believe your account has been accessed without permission.

We may suspend or terminate your account if you violate these Terms, provide false or misleading information, or engage in fraudulent activity.

6. Authentication

Every Item is authenticated by LegitGrails, an independent authentication service, before it is listed. Full details of this process are set out on our Authentication page, which forms part of these Terms.

Authentication is an expert opinion based on the images and information available at the time of review. If an Item is ever determined to be inauthentic, the remedy available to you is set out in our Refund Policy.

7. Condition Grading

Each Item is individually assessed and assigned a Condition Grade, described in detail on our Condition Grading page, which forms part of these Terms. Condition Grades and the written condition report on each listing reflect the actual state of the specific Item.

8. Orders and Payment

When you place an Order, you agree to provide accurate and complete information. You will receive an order confirmation once payment has been processed successfully.

Because every Item is a single, unique piece, an Order is only confirmed once payment is successfully processed and the Item is confirmed as available. In the rare case that an Item becomes unavailable after you order it (for example, due to a processing error), we will notify you and issue a full refund.

All payments are processed through Shopify Payments. We do not store full card numbers or payment credentials.

Prices are displayed in USD at checkout and do not include import duties, customs charges, or local taxes for your destination country. These are your responsibility as the buyer and are assessed in accordance with the import rules of your country of receipt. See our Shipping page for full details.

We reserve the right to refuse or cancel an Order if information provided is incomplete or inaccurate, payment cannot be verified, we detect fraudulent activity, or the Order cannot be fulfilled for operational reasons. If we cancel an Order before dispatch, we will issue a full refund.

9. Shipping

We ship to the countries listed on our Shipping page, which forms part of these Terms. Delivery times, shipping costs, and insurance coverage are set out there.

You are responsible for ensuring the shipping address you provide is accurate. You are also responsible for any import duties, customs charges, or local taxes payable in your destination country, in accordance with the rules of your country of receipt.

Certain Items may be subject to import or export restrictions in your country (for example, items containing exotic animal materials regulated under CITES). It is your responsibility to check whether an Item can lawfully be imported into your country before ordering. We reserve the right to refuse shipment where we reasonably believe an Item cannot be lawfully imported to your destination.

10. Returns, Refunds, and Your Right to Cancel

Our Refund Policy sets out in full when returns are accepted, how refunds are processed, and, if you are located in the European Union or United Kingdom, your statutory right to cancel your Order. The Refund Policy forms part of these Terms.

11. Trademark, Brand Affiliation, and Intellectual Property Disclaimer

TheLuxeArchive is an independent resale marketplace. We are not affiliated with, sponsored by, endorsed by, or officially connected to any brand whose products are listed on our website.

All trademarks, logos, and brand names referenced on our website belong solely to their respective owners. Any use of these marks is strictly for identification and descriptive purposes and does not imply partnership, endorsement, or approval by the brand owner.

All content on our website, including photography, written descriptions, condition reports, and site design, is owned by TheLuxeArchive or our licensors. You may not copy, reproduce, or reuse this content without our written permission.

12. User Conduct

You agree to use the Services lawfully and not to interfere with the proper operation of the website, attempt unauthorized access, scrape or copy content, or submit false or misleading information.

13. Warranties and Disclaimers

Items sold on TheLuxeArchive are pre-owned and sold as described in the individual listing, condition report, and Condition Grade. Our authenticity guarantee and condition guarantee, and the remedies available to you, are set out in full in our Warranty page and Refund Policy.

Except as expressly stated in these Terms, our Warranty page, and our Refund Policy, the Services and Items are provided without further warranties of any kind, to the maximum extent permitted by law. Nothing in these Terms excludes or limits any statutory right that cannot lawfully be excluded or limited, including statutory consumer guarantees available to you under the law of your country of residence.

14. Limitation of Liability

To the maximum extent permitted by law, TheLuxeArchive's total liability to you in connection with an Order is limited to the purchase price paid for the relevant Item, except in the case of death, personal injury, or fraud caused by our negligence, or any other liability that cannot lawfully be limited or excluded.

Nothing in this clause limits any right you have under mandatory consumer protection law in your country of residence.

15. Third-Party Tools and Links

We use third-party providers to operate our website, process payments, ship orders, and perform authentication services. Their use of your data is described in our Privacy Policy. We are not responsible for the content or practices of third-party websites linked from our site.

16. Data Protection

Our Privacy Policy explains how we collect, use, and protect your personal data, and forms part of these Terms.

17. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, provide false information, or engage in activity that creates risk to us, other users, or third parties. Termination does not affect obligations or rights that arose before termination.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or posted on our website. Continued use of the Services after changes take effect means you accept the updated Terms. Changes do not affect Orders already placed before the change took effect.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong. If you have a concern, please contact us first at info@theluxearchive.co so we can try to resolve it directly.

If a dispute cannot be resolved informally, it may be brought before the competent courts of Hong Kong, which have non-exclusive jurisdiction, without prejudice to any mandatory consumer protection rights you have under the law of your country of residence, which may entitle you to bring proceedings in your local courts and which cannot be limited by this clause.

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping page, Warranty page, Authentication page, and Condition Grading page, form the entire agreement between you and TheLuxeArchive regarding your use of the Services.

If any part of these Terms is found invalid or unenforceable, the remainder continues to apply. Our failure to enforce a right does not waive that right.
